Scope of this Policy
This Policy applies to individuals that subscribe to and use any MX Guardian service, as well as individuals that do not subscribe to or use any MX Guardian service but may have sent or received emails to or from users or subscribers of MX Guardian services or who visited the Site. By providing information to us when subscribing, contacting or communicating with us, or using the Site, you consent to the data practices described in this Policy.
Collection of your Personal Information
MX Guardian collects personal information that you voluntarily provide when using the Site. Examples of information we collect are your name, email address and phone number. If you purchase MX Guardian’s products and services, we collect billing address and credit card information. This information is used to complete the purchase transaction.
Information about your computer hardware and software may be automatically collected by MX Guardian. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the MX Guardian website.
In addition, MX Guardian collects a variety of information about users and subscribers to MX Guardian services and about other individuals that send or receive email to or from such users and subscribers. That information includes, without limitation, email address, email message content, and attachments (including non-spam messages). We also collect metadata about emails, such as header information (e.g., sender, recipient, times & dates, subject line), message structure, content type, and IP addresses of sending servers.
Use of your Personal Information
MX Guardian uses information about you for our legitimate interests, including:
- To deliver the services you have requested, including but not limited to: anti-spam, anti-virus, email spooling, email quarantining, and email delivery services
- To provide you with support or maintenance of your account
- To notify you that messages have not been delivered and/or quarantined
- To notify you of new or improved features
- To inform you of other products or services available from MX Guardian and its affiliates.
- To conduct surveys about your opinion of current services or of potential new services that may be offered.
- To respond to your inquiries
- To bill you for our services
- To improve our email filtering technology
MX Guardian will not sell, rent or lease your information except in the event that MX Guardian (in whole or in part) is sold, transferred, or merged with a third party. In such an event, customer information might be included among the transferred assets and MX Guardian reserves the right to share information it has about you. Notwithstanding any such transfer, your information will remain subject to this Policy. You will be notified at least 30 days in advance via email and/or prominent notice on our Web site of any change in ownership or uses of your information, as well as any choices you may have regarding your information.
MX Guardian may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to MX Guardian, and they are required to maintain the confidentiality of your information.
MX Guardian will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on MX Guardian or the site; (b) protect and defend the rights or property of MX Guardian; and, (c) act under exigent circumstances to protect the personal safety of users of MX Guardian, or the public.
European Privacy Rights
If you are an individual from the European Economic Area (EEA), our legal basis for collecting and using the personal information will depend on the personal information concerned and the specific context in which we collect it. However, we will collect personal information from you only where: (a) we have your consent to do so, (b) where we need the personal information to perform a contract with you (e.g. to deliver the MX Guardian services you have requested), or (c) where the processing is in our legitimate interests (and not overridden by your data protection interests or fundamental rights and freedoms).
Where we rely on your consent to process your personal information, you have the right to access, rectify, or erase any personal data we have collected about you. You also have the right to data portability and the right to restrict or object to our processing of personal data we have collected about you. In addition, you have the right to ask us not to process your personal data (or provide it to third parties to process) for marketing purposes or purposes materially different than for which it was originally collected or subsequently authorized by you. You may withdraw your consent at any time for any data processing we do based on consent you have provided to us. Please note that this does not affect the lawfulness of the processing based on consent before its withdrawal.

If your information has been processed by us on behalf of one of our customers and you wish to exercise any rights you have with such information, please inquire with our customer directly. If you wish to make your request directly to MX Guardian, please provide the name of the MX Guardian customer on whose behalf MX Guardian processes your information. We will refer your request to that customer, and will support them to the extent required by applicable law in responding to your request.
If you have any issues with our compliance, you have the right to lodge a complaint with a European supervisory authority.
The MX Guardian website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize MX Guardian pages, or register with MX Guardian site or services, a cookie helps MX Guardian to recall your specific information on subsequent visits. This simplifies the process of recording your personal information and preferences. When you return to the same MX Guardian website, the information you previously provided can be retrieved, so you can easily use the MX Guardian features that you requested.

Security of your Personal Information
When sensitive financial information (such as a credit card number) is transmitted to MX Guardian, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
When email messages are sent to or received from a third party via the Internet, they are always encrypted using the TLS protocol provided that the other party supports similar encryption protocols. If the other party does not support a compatible encryption method, the message is sent unencrypted.
Children Under Thirteen
MX Guardian does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.
Opt-Out & Unsubscribe
We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from MX Guardian by contacting us on our contact page, or by clicking the unsubscribe link at the bottom of any email message from us.
Changes to this Policy
MX Guardian will occasionally update this page to reflect changes in our privacy practices. If we make any material changes we will notify you by email (sent to the administrative e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
