MXGuardian, LLC (“MXGuardian”) creates software and services to filter email based on content (“Services”) and operates web sites located at mxguardian.com and mxguardian.net (collectively, the “Site”). This Privacy Policy (“Policy”) is intended to describe the kinds of information that we may collect on the Site, how we use and share that information, how we protect that information, how you can exercise your rights, how we make changes to this Policy, and how you can contact us if you have any questions about this Policy.
Scope of this Policy
This Policy applies to individuals that subscribe to and use any MXGuardian service, as well as individuals that do not subscribe to or use any MXGuardian service but may have sent or received emails to or from users or subscribers of MXGuardian services or who visited the Site. By providing information to us when subscribing, contacting or communicating with us, or using the Site, you consent to the data practices described in this Policy.
You might use MXGuardian services through a portal provided by us on behalf of our customer, such as your employer, Internet Service Provider, hosting company, or another third-party service provider. In that case, the other provider may have its own privacy policy and both may apply to you. MXGuardian is not responsible for the privacy policies of third parties.
Collection of your Personal Information
MXGuardian collects personal information that you voluntarily provide when using the Site. Examples of information we collect are your name, email address and phone number. If you purchase MXGuardian’s products and services, we collect billing address and credit card information. This information is used to complete the purchase transaction.
Information about your computer hardware and software may be automatically collected by MXGuardian. This information can include: your IP address, browser type, domain names, access times and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the MXGuardian website.
In addition, MXGuardian collects a variety of information about users and subscribers to MXGuardian services and about other individuals that send or receive email to or from such users and subscribers. That information includes, without limitation, email address, email message content, and attachments (including non-spam messages). We also collect metadata about emails, such as header information (e.g., sender, recipient, times & dates, subject line), message structure, content type, and IP addresses of sending servers.
Use of your Personal Information
MXGuardian uses information about you for our legitimate interests, including:
- To deliver the services you have requested, including but not limited to: anti-spam, anti-virus, email spooling, email quarantining, and email delivery services
- To provide you with support or maintenance of your account
- To notify you that messages have not been delivered and/or quarantined
- To notify you of new or improved features
- To inform you of other products or services available from MXGuardian and its affiliates.
- To conduct surveys about your opinion of current services or of potential new services that may be offered.
- To respond to your inquiries
- To bill you for our services
- To improve our email filtering technology
MXGuardian will not sell, rent or lease your information except in the event that MXGuardian (in whole or in part) is sold, transferred, or merged with a third party. In such an event, customer information might be included among the transferred assets and MXGuardian reserves the right to share information it has about you. Notwithstanding any such transfer, your information will remain subject to this Policy. You will be notified at least 30 days in advance via email and/or prominent notice on our Web site of any change in ownership or uses of your information, as well as any choices you may have regarding your information.
MXGuardian may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to MXGuardian, and they are required to maintain the confidentiality of your information.
MXGuardian will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on MXGuardian or the site; (b) protect and defend the rights or property of MXGuardian; and, (c) act under exigent circumstances to protect the personal safety of users of MXGuardian, or the public.
European Privacy Rights
If you are an individual from the European Economic Area (EEA), our legal basis for collecting and using the personal information will depend on the personal information concerned and the specific context in which we collect it. However, we will collect personal information from you only where: (a) we have your consent to do so, (b) where we need the personal information to perform a contract with you (e.g. to deliver the MXGuardian services you have requested), or (c) where the processing is in our legitimate interests (and not overridden by your data protection interests or fundamental rights and freedoms).
Where we rely on your consent to process your personal information, you have the right to access, rectify, or erase any personal data we have collected about you. You also have the right to data portability and the right to restrict or object to our processing of personal data we have collected about you. In addition, you have the right to ask us not to process your personal data (or provide it to third parties to process) for marketing purposes or purposes materially different than for which it was originally collected or subsequently authorized by you. You may withdraw your consent at any time for any data processing we do based on consent you have provided to us. Please note that this does not affect the lawfulness of the processing based on consent before its withdrawal.
To exercise any of these rights, contact us at privacy@mxguardian.net and specify which right you intend to exercise. We will respond to your request within 30 days. We may require additional information from you to allow us to confirm your identity.
If your information has been processed by us on behalf of one of our customers and you wish to exercise any rights you have with such information, please inquire with our customer directly. If you wish to make your request directly to MXGuardian, please provide the name of the MXGuardian customer on whose behalf MXGuardian processes your information. We will refer your request to that customer, and will support them to the extent required by applicable law in responding to your request.
If you have any issues with our compliance, you have the right to lodge a complaint with a European supervisory authority.
Use of Cookies
The MXGuardian website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.
One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the Web server that you have returned to a specific page. For example, if you personalize MXGuardian pages, or register with MXGuardian site or services, a cookie helps MXGuardian to recall your specific information on subsequent visits. This simplifies the process of recording your personal information and preferences. When you return to the same MXGuardian website, the information you previously provided can be retrieved, so you can easily use the MXGuardian features that you requested.
You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the MXGuardian services or websites you visit.
Security of your Personal Information
When sensitive financial information (such as a credit card number) is transmitted to MXGuardian, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.
When email messages are sent to or received from a third party via the Internet, they are always encrypted using the TLS protocol provided that the other party supports similar encryption protocols. If the other party does not support a compatible encryption method, the message is sent unencrypted.
Children Under Thirteen
MXGuardian does not knowingly collect personally identifiable information from children under the age of thirteen. If you are under the age of thirteen, you must ask your parent or guardian for permission to use this website.
Opt-Out & Unsubscribe
We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from MXGuardian by contacting us on our contact page, or by clicking the unsubscribe link at the bottom of any email message from us.
Changes to this Policy
MXGuardian will occasionally update this page to reflect changes in our privacy practices. If we make any material changes we will notify you by email (sent to the administrative e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective.
